Our unique model ensures that as our purchasing volume increases, we can negotiate better prices with our suppliers. These savings are then 100% passed on to you, our valued customers. Simply put, the more you buy, the better your pricing becomes.
By registering for and using the Pharmer’s Market, you agree to be bound by the following terms and conditions. Please read them carefully before proceeding.
Eligibility and Verification
Registration and access to the Pharmer’s Market are strictly limited to licensed medical facilities. By registering, you represent and warrant that your facility holds a valid and current license to operate as a medical facility in your state. We reserve the right to verify the accuracy of the information provided during registration, including your facility’s state license number. Failure to provide accurate information or misrepresentation of your facilities licensing status will result in the denial of access to the Pharmer’s Market or immediate termination of your account. It is your responsibility to promptly notify us of any changes to your facility’s licensing status or contact information.
Account Creation and Security
Upon successful verification of your facility’s license, we will issue you a unique username and password to access the Pharmer’s Market. This process allows us to ensure that only authorized medical facilities gain access to our platform, further enhancing the security and integrity of your sensitive information.

· We employ robust measures to safeguard your data and prevent unauthorized access.
It is your responsibility to keep your login credentials confidential and not share them with anyone. If you suspect any unauthorized access to your account, notify us immediately.
Countryside Medical Supply reserves the right to suspend or terminate your account at any time for any reason, including but not limited to:
· Violation of these terms and conditions;
· Provision of false or misleading information during registration; and/or
· Suspected fraudulent activity
Use of Web Shop

The Pharmer’s Market web shop is exclusively for the purpose of ordering medical and dental supplies by licensed medical facilities. Any other use of the web shop, including but not limited to reselling products or distributing them to unauthorized individuals or entities, is strictly prohibited.
We strive to provide accurate and up-to-date product information, including descriptions, images and pricing. However, we do not guarantee the accuracy or completeness of this information. It is your responsibility to verify any product information before placing an order.
· You can place orders through the web shop by adding items to your cart and proceeding to checkout;
· All orders are subject to our acceptance, and we reserve the right to refuse or cancel any order for any reason, including but not limited to product unavailability, pricing errors, cost fluctuations or suspected fraudulent activity;
· Prices are subject to change without notice;
· Payment is due at the time of order placement;
· We accept various payment methods as specified on the web shop
We strive to process and ship orders promptly. However, delivery times may vary depending on your location and product availability. Shipping costs will be calculated and displayed during checkout. We are not responsible for any delays or damage caused by the shipping carrier or third parties. You can track the status of your orders through your account on the web shop.
Intellectual Property
All content and materials available on the Pharmer’s Market, including but not limited to text, graphics, logos, images, software and audio clips are the property of Countryside Medical Supply or its licensors and are protected by copyright, trademark and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Pharmer’s Market and its content solely for the purpose of placing orders for medical and dental supplies for your licensed medical facility. You may not:
· Copy, reproduce, modify, distribute, display or transmit any content from the Pharmer’s Market without our prior written consent;
· Use any automated means, including robots, spiders or scrapers to access or collect information from the Pharmer’s Market;
· Reverse engineer, decompile or disassemble any software or technology used in connection with the Pharmer’s Market; and/or
· Use the Pharmer’s Market for any illegal or unauthorized purpose.
We take the protection of our intellectual property seriously and will vigorously fully enforce our rights of the law.
Payment and Shipping
Payment for all orders is due in full at the time of order placement. For your convenience, we accept the following payment methods:
· Credit/Debit Cards
· Google Pay
· ACH/Bank Transfer – through Paze Wallet
· Protected Payment Link
If applicable, processing fees may apply to certain payment methods.
At Countryside Medical Supply, we strive to process and ship orders as quickly as possible. However, shipping times may vary depending on your location, product availability, payment completion and the shipping method chosen. Shipping costs will be calculated and displayed during the checkout process based on your shipping address, weight and dimensions of your order.
Unless otherwise agreed upon in writing, orders will not be shipped until payment is made and received in full. Invoice Payments or Pay Link Payments are considered late after 10 days. On the 11thday, late payments may be subject to a monthly late fee of 1.5% of the outstanding balance, charged on that day monthly until settled. We offer various shipping options, including:

We are not responsible for any third-party delays, damages or losses incurred during the fulfillment and shipping process. Any claims for damaged or lost shipments should be directed to the carrier. Once your order has shipped, you will receive a tracking number via email. You can use this number to track the progress of your shipment on the carrier’s website.
Returns and Refunds
Due to the medical nature of our products and to ensure patient safety, many items purchased through the Pharmer’s Market are final sale and non-refundable. This includes, but is not limited to, items that are:
· Sterile or Single-Use;
· Opened or Damaged;
· Expired or Nearing Expiration; and/or
· Custom-Ordered or Specifically Manufactured;
We understand that there may be exceptional circumstances where a return or refund is necessary. We will consider requests for returns or refunds on a case-by-case basis, taking into account factors such as:
· Product Defects or Damages;
· Shipping Errors or Incorrect Items Received; and/or
· Other Extenuating Circumstances as determined our discretion
Please note that in some cases, the final decision on returns or refunds may rest with the manufacturer or third-party supplier of the product, and we will facilitate communication and coordination as needed.
If you believe you have a valid reason for a return or refund, please email your concern to fulfillment@countrysidemedsupply.comwithin 48 hours of receiving your order. We will provide you with instructions on how to proceed with the return, including any necessary documentation or authorization. All approved returns may be subject to a restocking fee of up to 25% of the purchase price. Original shipping costs are non-refundable. Return shipping costs are the responsibility of the customer, unless the return is due to our error.
Privacy and Data Protection
We collect business and personal information from you during the registration and purchasing process, such as your name, contact details and facility information. We may also collect information about your orders, browsing behavior and interactions with our website or customer support team. We use the collected information to:
· Process and fulfill your orders;
· Communicate with you about your account, orders and any relevant updates or promotions;
· Improve our website, products and services; and
· Comply with legal and regulatory requirements
As part of these efforts, we may share your information with:
· Third-Party Service Providers who assist us with order fulfillment, payment processing, shipping and other essential business functions; and
· Regulatory Authorities or law enforcement agencies as required by law or to protect our rights or the safety of others.
As general practice, we implement industry-leading security measures to protect your personal information from unauthorized access, use or disclosure. However, no method of transmission over the internet or electronic storage is 100% secure and we cannot guarantee absolute security.
· HIPAA Compliance: We are committed to complying with the Health Insurance Portability and Accountability Act (HIPAA) and other applicable privacy laws to protect the confidentiality and security of your health information.
· Your Rights: You have the right to access, correct or delete your personal information. You can also opt out of receiving marketing communications from us at any time.
We may update our privacy policy from time to time. Any changes will be posted on our website, and your continued use of the Pharmer’s Market constitutes your acceptance of the updated policy.
Confidentiality and Non-Disclosure:
You acknowledge that during your use of the Pharmer’s Market, you may have access to confidential information, including but not limited to pricing, product availability and customer data. You agree to keep all such information confidential and not to disclose it to any third party without our prior written consent. This confidentiality obligation shall survive the termination of this Agreement or your access to the Pharmer’s Market. The confidentiality obligation does not apply to information that:
· Is or because publicly available through no fault of yours;
· Was already known to you before accessing the Pharmer’s Market;
· Is independently developed by you without reference to our confidential information; and
· Is required to be disclosed by law or a court order
Indemnity
You agree to indemnify, defend and hold harmless Countryside Medical Supply, its affiliates, officers, directors, employees and agents from and against any and all claims, damages, losses, liabilities, costs and expenses (including reasonable attorney’s fees) arising out of or in connection with:
· Your use of the Pharmer’s Market;
· Your breach of these terms and conditions;
· Your violation of any applicable law or regulation; and/or
· Any claims arising from your use of the products or services purchased through the Pharmer’s Market
Our liability to you for any damages arising out of or in connection with this Agreement or your use of the Pharmer’s Market shall not exceed the total amount paid by you for the products or services giving rise to the claim. We shall not be liable for any indirect, incidental, special, consequential or punitive damages, even if we have been advised of the possibility of such damages.
Dispute Resolution
In the event of any dispute arising out of or in connection with this Agreement or your use of the Pharmer’s Market, the parties agree to first attempt to resolve the dispute through good faith negotiations. If the parties are unable to resolve the dispute through negotiation within 30 days, either party may initiate mediation by providing written notice to the other party. The parties shall mutually agree on a mediator and share the costs of mediation equally.
If mediation fails to resolve the dispute within 45 days, either party may initiate binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the Denver Metro Area in the State of Colorado, and the decision of the arbitrator shall be final and binding on both parties.
Limitation of Liability
The Pharmer’s Market and all products and services offered through it are provided “as is” and without warranties of any kind, whether express or implied. We disclaim all warranties, including but not limited to, implied warranties of merchantability, fitness for a particular purpose and non-infringement.
To the maximum extent permitted by law, Countryside Medical Supply shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages, including but not limited to, loss of profits, data, or use, incurred by you or any third party, whether in an action in contract, tort or
otherwise, arising from your access to or use of, or your inability to access or use, the Pharmer’s Market or any products or services purchased through it.
In no event shall our total liability be to you for all damages, losses and causes of action exceeding the amount paid by you, if any, for accessing or using the Pharmer’s Market or for the specific products or services giving rise to the claim.
Governing Laws and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of laws principles. Any legal action or proceeding arising out of or in connection with the Agreement or your use of the Pharmer’s Market shall be brought exclusively in the state or federal courts located in Jefferson County, Colorado. You hereby consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.
Termination
You may terminate this Agreement at any time by closing your account and ceasing to use the Pharmer’s Market. We may terminate this Agreement or suspend your access to the Pharmer’s Market at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to:
· Breach of these terms and conditions;
· Failure to provide accurate or updated information;
· Suspected fraudulent activity;
· Non-payment of any outstanding fees or invoices; and/or
· Any other reason at our sole discretion
Upon termination of this Agreement:
· Your access to the Pharmer’s Market will be revoked;
· Any outstanding orders will be cancelled;
· You will remain liable for any unpaid fees or charges;
· Certain provisions of this Agreement, such as confidentiality, indemnity and dispute resolution, will survive termination
Agreement to Terms and Conditions
By clicking the “I Agree” button during registration and subsequently, by logging in to the Pharmer’s Market, you acknowledge that you have read, understood and agree to be bound by these terms and conditions. Our failure to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
This Agreement constitutes the entire agreement between you and Countryside Medical Supply regarding your use of the Pharmer’s Market and supersedes all prior or contemporaneous communications and proposals, whether oral or written. If any provisions of this Agreement is held to be invalid or unenforceable, such provision shall be struck out of the Agreement and the remaining provisions shall remain in full force and effect.
